Lateral and subjacent support, in the law of property, describes the right a landowner has to have that land physically supported in its natural state by both adjoining land and underground structures. If a neighbor’s excavation causes the landowners land to cave in, the neighbor will be subject to strict liability in a tort action. The neighbor will also be strictly liable for damage to buildings on the landowner’s property if the landowner can show that the weight of the buildings did not contribute to the collapse of the land. If the landowner is unable to make such a showing, the neighbor must be shown to have been negligent for the landowner to recover any damages.

Because the landowner owns everything beneath the ground on his property, he may convey to another party the rights to mineral deposits under the land, and other things requiring excavation. However, such a conveyance requires the recipient to prevent any damage to the surface of the land caused by the excavation, unless the conveyance itself grants express authority for the surface land to be damaged “as reasonably necessary” for the recipient to exercise his extraction rights.

James W. Walter, Sr. (September 18, 1922–January 6, 2000), of Tampa, Florida in the United States, was a home builder who started Jim Walter Homes and Walter Industries in 1946 with $1,000 he borrowed from his father. Walters eventually sold the company in 1986 for $2 billion to KKR.

Jim Walter homes were “shell” homes meaning the company would complete the outside so that the house was water tight and then allow the customer to finish the inside with his own labor and materials. The result was very affordable homes.

In 1961 he bought Celotex using just stock in Jim Walter Homes. The Wall Street Journal wrote, “Jonah has just swallowed the whale.”

In 1968, Walter bought US Pipe and Foundry. Later, Walter acquired Fry Roofing, Georgia Marble, and various other building material companies.

His wife, Monica Walter, died in 1982, leaving two sons, James W. Walter and Robert Walter. He was the son of Ebe and Mabel Walter. The book Building a Business: The Jim Walter Story tells his story.

In all the civil law systems, immovable property is the equivalent of “real property” in common law systems, i.e. it is land or any permanent feature or structure above or below the surface.

In the United States, immovable property is any immovable object, real estate, item of property that can not be moved. Includes premises and property rights (for example, heritable building right), houses, land and associated goods and chattels.

Michael Sellers (Born July 21, 1975 in Frankfurt, Germany), is an American football player in the NFL for the Washington Redskins. He was the youngest import player to sign a CFL deal in the history of the football league when he played at 19 years old for the Edmonton Eskimos.

Sellers attended North Thurston High School in Lacey, Washington and was a letterman in football, basketball and track. As a senior, Sellers was named Washington state’s Prep Player of the Year and the Offensive Player of the Year.


Junior College Years

Sellers attended Walla Walla University and earned J.U.C.O. All-America honors as a linebacker.

Sellers attained some stardom in the Canadian Football League, where he moved to fullback and appeared for the Eskimos and the Winnipeg Blue Bombers. With the Blue Bombers, he was the power half of what was then the league’s most dangerous rushing duo, “Thunder and Lightning”, with fleet-footed running back Charles Roberts.

In a February, 2005 article in The Seattle Times, Sellers was named as one of the 25 greatest running backs in state history. [1]

Sellers has one child, Kailyn.


Professional Career

Sellers has been instrumental in the success of two thousand yard running backs for the Washington Redskins, Ladell Betts and Clinton Portis. “Gravy Boat” is often used in short yardage and red zone situations because his tremendous size makes him difficult to bring down.

The Bob Thomas Equestrian Center is an equestrian center located on the Florida State Fairgrounds in Tampa, Florida.

The center “includes exercise grounds, warm-up rings, two show rings, and a grand prix ring.” In addition, the center has a “9,000 square foot indoor pavilion” that “can accommodate exhibitor banquet and festival seating overlooking the show rings, all in a climate-controlled environment.” There’s also 471 permanent stalls in five barns, plus plenty of parking and a full service restaurant. [1]

Manifesto Records is the name of an independent record label based in Los Angeles that has released records by The Wedding Present, Dead Kennedys, Tom Waits, Tim Buckley, Lilys, Concrete Blonde, Screamin’ Jay Hawkins and others. Manifesto released the entire catalogue of Dead Kennedys in 2001 after the band obtained the rights from former label Alternative Tentacles. Manifesto Records, the independent label, is completely unaffiliated with the Manifesto Records listed below.

Manifesto Records is also a dance subsidiary of Mercury Records located in the UK.

Geopotential is the potential of the Earth’s gravity field. For convenience it is often defined as minus the potential energy per unit mass, so that the gravity vector is obtained as the gradient of this potential, without the minus.

For geophysical applications, gravity is distinguished from gravitation. Gravity is defined as the resultant of gravitation and the centrifugal force caused by the Earth’s rotation. The global mean sea surface is close to one of the equipotential surfaces of the geopotential of gravity. This equipotential surface, or surface of constant geopotential, is called the geoid.

For the purpose of satellite orbital mechanics, the geopotential is typically described by a series expansion into spherical harmonics (spectral representation). In this context the geopotential is taken as the potential of the gravitational field of the Earth, that is, leaving out the centrifugal potential.

An electronic logbook is a computer based software for recording (logging) states, events or simply conditions used for complex machines like nuclear plants, particle accelerators, etc.

This version of a logbook was derived from the old-fashioned paper based logbooks which have been used in the maritime sector (see also logbook). Today a wide spectrum of different implementations of these electronic logbooks is available, even if most versions are based on the classical client-server approach. Here the electronic logbook serves a client which is in most cases a simple web browser (see picture below).

La Orchila is a military base off the coast of Venezuela. It has numerous beaches, including one where the sand is markedly pink (Playa Rosada). The highest peak with 139 m is Cerro Walker.

There is a presidential retreat on this island, and the residential complex reserved for the military houses consists mainly of elevated houses made of wooden logs. There is also a court for bolas criollas. All the facilities are connected by pathways, mostly unpaved but smooth and clean.

RFM is a method used for analyzing customer behavior and defining market segments. It is commonly used in database marketing and direct marketing and has received particular attention in retail.

RFM stands for

  • Recency - When was the last order?
  • Frequency - How many orders have they placed with us?
  • Monetary Value - What is the value of their orders?

To create an RFM analysis, one creates categories for each attribute. For instance, the Recency attribute might be broken into three categories: customers with purchases within the last 90 days; between 91 and 365 days; and longer than 365 days. Such categories may be arrived at by applying business rules, or using a statistical technique, such as CHAID, to find meaningful breaks.

Once each of the attributes has appropriate categories defined, segments are created from the intersection of the values. If there were three categories for each attribute, then the resulting matrix would have twenty-seven possible combinations (one well-known commercial approach uses five bins per attributes, which yields 125 segments). Companies may also decide to collapse certain subsegments, if the gradations appear too small to be useful. The resulting segments can be ordered from most valuable (highest recency, frequency, and value) to least valuable (lowest recency, frequency, and marketing). Identifying the most valuable RFM segments can capitalize on chance relationships in the data used for this analysis. For this reason, it is highly recommended that another set of data be used to validate the results of the RFM segmentation process.

Advocates of this technique point out that it has the virtue of simplicity: no specialized statistical software is required, and the results are readily understood by business people. In the absence of other targeting techniques, it can provide a lift in response rates for promotions.


Criticism

Critics take issue on several points. First, the method is descriptive only, and does not provide a mechanism to forecast behavior as a predictive model might. Second, when used to target customers for promotion, it assumes that customers are likely to continue behaving in the same manner. Finally, when used as the primary targeting method, it may lead to overmarketing to the most attractive RFM segments and to neglect of other segments that would be profitable if developed properly.


Variations

RFD - Recency, Frequency, Duration is a modified version of RFM analysis that can be used to analyze consumer behavior of viewership/readership/surfing oriented business products. (For example, amount of time spent by surfers on Wikipedia)

In biology, psychology and sociology social behavior is behavior directed towards, or taking place between, members of the same species. Behavior such as predation which involves members of different species is not social. While many social behaviors are communication (provoke a response, or change in behavior, without acting directly on the receiver) communication between members of different species is not social behavior.

In sociology, “behavior” itself means an animal-like activity devoid of social meaning or social context, in contrast to “social behavior” which has both. In a sociological hierarchy, social behavior is followed by social action, which is directed at other people and is designed to induce a response. Further along this ascending scale are social interaction and social relation.
In conclusion, social behaviour is a process of communicating.

Samna

was an Atlanta, Georgia, USA based computer software company that was bought by Lotus Development Corporation in November 1990 for $65 million USD. Samna was famous for introducing Ami, a graphics-based word processor, in 1988, which was the first major Windows-based word processor on the market (Word for Windows 1.0 would not debut until early 1989). Windows 3.0 versions were being shipped when Lotus acquired the company, and Ami Pro was folded into Lotus’s product line, first becoming Lotus Ami Pro, and then later evolving into Lotus Word Pro.

Multipotent progenitor cells can give rise to several other cell types, but those types are limited in number. An example of a multipotent stem cell is a hematopoietic cell — a blood stem cell that can develop into several types of blood cells, but cannot develop into brain cells or other types of cells. At the end of the long series of cell divisions that form the embryo are cells that are terminally differentiated, or that are considered to be permanently committed to a specific function.

Scientists have long held the opinion that differentiated cells cannot be altered or caused to behave in any way other than the way in which they have been naturally committed. New research, however, has even called that assumption into question. In recent stem cell experiments, scientists have been able to persuade blood stem cells to behave like neurons, or brain cells. Scientists now believe that stem cell research could reveal far more vital information about our bodies than was previously known. There is also continuing research to see if it is possible to make multipotent cells into pluripotent cells.

An Internet Data Exchange (IDX) is a real estate property search site which allows the public to conduct searches of approved Multiple Listing Service properties in a certain area.

Site users generally gain the benefit of anonymous property searching and review. IDX sites usually provide less detailed information than the full Realtor Multiple Listing Service, limiting the data to that which is deemed publicly accessible. The benefit to realtors is that users of their IDX web site can search freely, establish some confidence, and qualify themselves before contacting the realtor.

Certain rules apply to the real estate companies’ ability to display each detail about a property. These “display rules” are set by the Multiple Listing Service organization, which generally forms its policy around the recommendations of the National Association of Realtors.

IDX policy is nearing its replacement by a new Internet Listing Display policy being formed by the National Association of Realtors.

A common and standard data exchange protocol for IDX information is the Real Estate Transaction Specification or RETS.

Stonebridge Park is a part of the Harlesden area of north-west London in the London Borough of Brent. The area was named after a stone bridge was built in the area, and has a large council estate called the Stonebridge Estate. The Stonebridge Estate is being redeveloped by the Housing Action Trust along with similar social housing estates in Waltham Forest, Tower Hamlets, Birmingham, Hull and Liverpool.

Crime levels connected with the Stonebridge Estate have been amongst the highest in London, however, in recent years alongside the regeneration of the estate, the level of street crime has been decreasing.

The nearest stations are Stonebridge Park station and Harlesden station. There are also four London bus routes that include Stonebridge: the 18, 112, 206 and PR2 buses.

Personal property is a type of property. In the common law systems personal property may also be called chattels. It is distinguished from real property, or real estate. In the civil law systems personal property is often called movable property or movables - any property that can be moved from one location to another. This term is in distinction with immovable property or immovables, such as land and buildings.

Personal property may be classified in a variety of ways, such as money, negotiable instruments, securities, goods, and intangible assets including chose in action.

Accountants also distinguish personal property from real property because personal property can be depreciated faster than improvements (while land is not depreciable at all). It is an owner’s right to get tax benefits for chattel, and there are businesses that specialize in appraising personal property, or chattel.

The distinction between these types of property is significant for a variety of reasons. Usually one’s rights on movables are more attenuated than one’s rights on immovables (or real property). The statutes of limitations or prescriptive periods are usually shorter when dealing with personal or movable property. Real property rights are usually enforceable for a much longer period of time and in most jurisdictions real estate and immovables are registered in government-sanctioned land registers. In some jurisdictions, rights (such as a lien or other security interest) can be registered against personal or movable property.

In the common law it is possible to place a mortgage upon real property. Such mortgage requires payment or the owner of the mortgage can seek foreclosure. Personal property can often be secured with similar kind of device, variously called a chattel mortgage, trust receipt, or security interest. In the United States, Article 9 of the Uniform Commercial Code governs the creation and enforcement of security interests in most (but not all) types of personal property.

There is no similar institution to the mortgage in the civil law, however a hypothec is a device to secure real rights against property. These real rights follow the property along with the ownership. In the common law a lien also remains on the property and it is not extinguished by alienation of the property; liens may be real or equitable.

Many jurisdictions levy a personal property tax, an annual tax on the privilege of owning or possessing personal property within the boundaries of the jurisdiction. Automobile and boat registration fees are a subset of this tax. Most household goods are exempt as long as they are kept or used within the household; the tax usually becomes a problem when the taxing authority discovers that expensive personal property like art is being regularly stored outside of the household.

In linguistics, exophora is reference to something extralinguistic, and contrasts with endophora. Exophora can be deictic, in which special words or grammatical markings are used to make reference to something in the context of the utterance or speaker. For example, pronouns are often exophoric, with words such as “this”, “that”, “here”, “there”, as in that chair over there is John’s said while indicating the direction of the chair referred to.
For example, given: “Did the gardener water those plants?” it is quite possible that “those” refers back to the preceding text, to some earlier mention of those particular plants in the discussion. But it is also possible that it refers to the environment in which the dialogue is taking place - to the “context of situation”, as it is called - where the plants in question are present and can be pointed if necessary. The interpretation would be “those plants there, in front of us”. This kind of reference is called exophora, since it takes us outside the text altogether. Exophoric reference is not cohesive, since it does not bind the two elements together into a text.

Homophoric references, which are a kind of exophora, are not a feature of grammar, but rather are generic phrases which are given a particular interpretation in a particular social context. For example, in the United Kingdom, “the Queen” is a homophoric reference to the Queen of the United Kingdom, whereas in the Netherlands “the Queen” is a homophoric reference to the Queen of the Netherlands.

An estate in land is an interest in real property that is or may become possessory.

This should be distinguished from an “estate” as used in reference to an area of land, and “estate” as used to refer to property in general.

In property law, the rights and interests associated with an estate in land may be conceptually understood as a “bundle of rights” because of the potential for different parties having different interests in the same real property.


Categories of estates

Estates in land can be divided into four basic categories:

  1. Freehold estates: rights of ownership

    • fee simple (fee simple absolute)—most rights, least limitations, indefeasible
    • fee tail—inalienable rights of inheritance
    • conditional, defeasible, or determinable fee—voidable ownership
    • life estate—ownership for duration of someone’s life
  2. Leasehold estates: rights of possession and use but not ownership. The lessor (owner/landlord) gives this right to the lessee (tenant). There are four categories of leasehold estates:
    1. estate for years (tenancy for years)—lease of any length with specific begin and end date
    2. periodic estate (periodic tenancy)—automatically renewing lease (month to month, week to week)
    3. estate at will (tenancy at will)—leasehold for no fixed time or period. It lasts as long as both parties desire. Termination is bilateral (either party may terminate at any time) or by operation of law.

The film concerns a female factory worker from Calabria who falls ill on the job and is prescribed a stay at a mountain retreat. She goes despite her husband’s wishes, leaving behind her thankless work shift and her frustrating in-laws, but also her three children.
